Terms of Use
1. Acceptance of Terms
By booking or participating in any trip, the client confirms that they have read, understood, and agreed to these Terms of Use, the Cancellation Policy, and the Liability Waiver.
2. Role of the Company
The Company acts solely as an independent organizer and facilitator of sailing experiences.
- The Company does not own, operate, or manage the vessels
- All yachts are chartered from licensed third-party providers
- Skippers and crew may be independent professionals or appointed by the charter provider
The Company acts strictly as an intermediary between the client and third-party service providers.
3. Assumption of Risk
The client acknowledges that sailing involves inherent risks, including but not limited to:
- Weather conditions
- Sea conditions
- Equipment failure
- Injury, illness, or death
Participation is voluntary and entirely at the client’s own risk.
4. Skipper Authority
The skipper has full authority over all safety and operational decisions, including route and itinerary changes.
All participants must comply with instructions at all times.
Failure to comply may result in removal from the trip without refund.
5. Health & Fitness
Clients confirm they are physically and mentally fit to participate.
Any relevant medical condition must be disclosed prior to the trip.
The Company is not liable for issues arising from undisclosed conditions.
6. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be held liable for:
- Personal injury, illness, or death
- Loss, theft, or damage of personal belongings
- Acts, omissions, or negligence of third-party providers (including charter companies, crew, marinas)
- Weather-related disruptions
- Mechanical or technical issues of the vessel
7. Itinerary Changes
The itinerary may be modified at any time due to safety, weather, or operational reasons.
No compensation shall be provided.
8. Behavior Policy
The Company reserves the right to remove any participant who:
- Acts dangerously or negligently
- Disrupts the group
- Violates laws or safety rules
No refund will be issued.
9. Insurance Responsibility
Clients are solely responsible for obtaining personal travel insurance, including:
- Medical coverage
- Trip cancellation
- Personal liability
10. Travel Arrangements
The Company is not responsible for any travel arrangements made by the client (including flights, ferries, or accommodation) and shall not be liable for any related costs in case of trip cancellation or modification.
11. Check-in Responsibility
Clients must arrive on time at the agreed departure location.
Late arrival is considered a no-show and no refund will be provided.
12. Damage & Responsibility
Clients are responsible for any damage caused to the vessel or equipment due to negligence or misuse and may be charged accordingly.
13. Minimum Participation
Each trip requires a minimum number of participants.
If this number is not reached, the Company reserves the right to cancel the trip.
14. Operational Disruptions
In case of unforeseen circumstances (including vessel breakdown, crew issues, port restrictions, or sudden weather changes), the Company will make reasonable efforts to adjust the itinerary or provide alternatives.
No guarantees are made regarding the exact execution of the original plan. No additional compensation shall be owed.
15. Media Consent
The Company may use photos and videos taken during the trip for promotional purposes unless the client explicitly opts out in writing prior to the trip.
16. Governing Law
These Terms are governed by the laws of Greece.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
